In the middle of last December, Myth of Empires studio Angela Game fired off a lawsuit against Snail Games and Studio Wildcard, demanding that the claim of copyright infringement that removed the game from Steam be heard in a jury trial. Thanks to reporting from MMO Fallout, we now know the latest step in the legal scuffle, and that step is Snail Games firing off countersuits of its own.
As reported by MMOFallout, which has copies of the lawsuit documents for viewing) the new suit is expansive, with not only Angela Game as a defendant, but also Tencent for apparently ignoring a DMCA letter to go ahead and shut down Myth of Empires’ servers. Tencent is named as having financial stakes in Angela Game and the game itself and with the company’s refusal to take down the servers, is effectively enabling theft. This lawsuit also includes additional accusations that Angela Game has been essentially tampering with evidence by changing bits of Myth of Empires’ code to hide any similarities.
Snail isn't just going after Angela. The suit also names Imperium Interactive Entertainment Ltd., which made the distribution agreement with Valve that put Myth of Empires on Steam. Finally, Tencent is also a target, as Snail Games believes it "indirectly owns a substantial interest in Angela" and "refuses to take down" the game from its servers," and because it "has actual knowledge of specific infringement, and refuses to take simple steps to end the infringement, Tencent is liable for contributory copyright infringement."
Snail Games is seeking all the damages, including disgorgement of profits from Tencent and the game’s sales; statutory damages; a permanent injunction on Angela, Imperium, and Tencent on future infringement; and legal and attorney fees, among other restitution demands.
If there was any hope for this situation to come to a quick resolution, it seems that is gone and this will take time for whatever conclusion ultimately results. Angela Game has continued development, and even opened up a holiday event in late December.
